Terms of Service & Licensing (ToS)

01. Initiation of Protocol (Acceptance)

By accessing the 404 Agency® network, commissioning a neural build, or utilizing our studio services, you ("The Operator") agree to be bound by these Terms. If you do not accept these parameters, disconnect from this terminal immediately.

02. Intellectual Property Architecture

We distinguish strictly between the Tool and the Output.

• 2.1 The Engine (Agency Property): 404 Agency® retains all rights, title, and interest in the underlying proprietary technology, source code, neural training methodologies, and base datasets ("The Foundry"). You may not reverse-engineer, decompile, or attempt to replicate our generation stack.

• 2.2 The Asset (Client Property): Upon full settlement of the "Setup Fee," the Client obtains 100% Commercial Ownership of the specific generated identity (The "Model"). This includes the visual likeness, voice print, backstory, and all generated content. You own the IP of the character; we own the factory that built it.

03. Financial Transmission

• Build Fees: All "Setup" and "Calibration" fees are non-refundable once the Neural Synthesis phase has begun.

• Maintenance: Monthly autonomy subscriptions (Level 2 & Enterprise) are billed in advance. Failure to transmit funds will result in the immediate "freezing" of the Model's hosting servers.

04. Operational Parameters (Prohibited Use)

Our technology is weaponized for influence, not harm. You agree NOT to utilize 404 Agency® models for:

• Non-consensual Deepfakes: Generating likenesses of living private citizens without written biometric consent.

• Political Interference: Manipulating election outcomes or spreading state-sponsored disinformation.

• Criminal Activity: Any acts defined as illegal under the jurisdiction of the United Kingdom or International Law.

The Kill Switch: 404 Agency® reserves the right to unilaterally terminate any model found violating these ethical parameters without refund.

05. Platform Volatility (Third-Party Liability)

We engineer models to bypass detection, but the landscape is hostile.

• Platform Risk: We are not liable if a third-party platform (Instagram, TikTok, X) bans, shadowbans, or restricts your Model due to updates in their "Bot/AI" policies.

• Adaptation: In the event of a ban, we will attempt to "re-skin" or migrate the identity for a fee, but we do not guarantee platform immunity.

06. The "Uncanny Valley" Disclaimer

While our rendering engines achieve 99.9% photorealism, digital artifacts may occur. 404 Agency® is not liable for public confusion regarding the biological status of the model.

07. Jurisdiction

These protocols are governed by the laws of London, United Kingdom. Any disputes regarding the nature of reality or contract will be resolved through arbitration, not litigation.
