404 Agency® ("The Foundry," "We," "Us") values data sovereignty.
1. Privacy Policy
Title: Data Integrity Protocol (Privacy Policy) Effective Date: January 1, 2026
01. Protocol Overview
404 Agency® ("The Foundry," "We," "Us") values data sovereignty. This document outlines how we intercept, process, and secure the information generated by your interaction with our digital infrastructure. By accessing this network, you consent to the processing of your digital footprint as described below.
02. Data Collection Parameters
We compile data in two categories:
Surface Data: Information you voluntarily transmit via our "Initiate Build" forms (Name, Corporate Identity, Email Frequency).
Telemetry: Passive data collected to optimize connection velocity, including IP addresses, browser fingerprinting, and interaction heatmaps.
Biometric Reference (Clients Only): For clients commissioning a "Digital Twin," we process high-fidelity facial and vocal data. This data is stored in air-gapped, encrypted servers and used solely for neural synthesis.
03. Neural Utilization (How We Use Data)
We do not sell data to third-party brokers. We use your data to:
Calibrate the performance of our website and services.
Train our proprietary internal algorithms (anonymized data only).
Establish secure communication channels for project deployment.
Comply with global "Know Your Customer" (KYC) regulations for IP licensing.
04. Data Sovereignty (Your Rights)
Under the General Data Protection Regulation (GDPR) and CCPA, you possess the right to:
Request Access: View the raw data file we hold on your entity.
Request Erasure: Demand the "Right to be Forgotten" (deletion of all non-essential records).
Opt-Out: Disengage from our tracking beacons (Cookies).
05. Security Architecture
We employ military-grade AES-256 encryption for all client communications. However, no transmission over the open internet is 100% secure. You acknowledge that "The error in the system is human," and assume the inherent risks of digital communication.

2. Terms of Use
Title: Terms of Service & Licensing (TOS) Last Updated: January 13, 2026
01. Acceptance of Protocol
By accessing this website or commissioning a 404 Agency® model, you agree to be bound by these Terms. If you do not agree, disconnect immediately.
02. Intellectual Property (The "Engine" vs. The "Asset")
The Engine: 404 Agency retains all rights, title, and interest in the underlying technology, neural networks, codebases, and generation methodologies used to create your model. You may not reverse-engineer, decompile, or attempt to replicate "The Engine."
The Asset: Upon full payment, the Client obtains 100% Commercial Ownership of the specific generated identity (The "Model"), including its likeness, backstory, and output content. You own the face; we own the factory that built it.
03. Permissible Use & Ethics
Our models are engineered for brand dominance, not deception. You agree NOT to use 404 Agency® models for:
Non-consensual Deepfakes of real, living private citizens.
Political misinformation campaigns or election interference.
Illegal activities as defined by the jurisdiction of the United Kingdom and International Law.
Violation Clause: We reserve the right to "Kill Switch" any model found violating these ethical parameters without refund.
04. The "Uncanny Valley" Disclaimer
While our models strive for photorealism, they are synthetic entities. 404 Agency® is not liable for:
Public confusion regarding the "realness" of the model.
Social media platform bans resulting from "non-human" behavior detection (though we optimize against this).
"Hallucinations" or erratic outputs if the client overrides our safety protocols (Level 2 Autonomy).
05. Limitation of Liability
To the maximum extent permitted by law, 404 Agency® shall not be liable for any indirect, incidental, or consequential damages resulting from the use of your AI Model. Our total liability is limited to the amount paid for the specific "Setup Fee."
06. Governing Law
These terms are governed by the laws of London, United Kingdom. Any disputes will be resolved through arbitration, not litigation.
